Court stops Levitikal firm from selling disputed Victoria Island property linked to Ajose

The Federal High Court sitting in Lagos has issued an interim injunction restraining Levitikal Realties & Construction Limited from selling, transferring, mortgaging, leasing, assigning or otherwise dealing with a disputed property located at No. 68 Molade Okoya Thomas Street, off Ajose Adeogun Street, Victoria Island, Lagos.

The order was made by Justice A. Lewis-Allagoa in Suit No. FHC/LAG/CS/1245/2026 following an application filed by Dr. (Mrs.) Maryam Sani Abacha against Levitikal Realties & Construction Limited.

The court also ordered that the property must not be dealt with in a manner that could prejudice the outcome of the ongoing proceedings.

The disputed property is covered by a Certificate of Occupancy dated July 4, 1988, and registered as No. 32 at Page 32 in Volume 1988B of the Lands Registry Office, Lagos State.

The order followed a Motion Ex Parte dated September 9, 2026, and filed on September 10, in which the applicant sought several interim orders pending the determination of a Motion on Notice for interlocutory injunction.

Among other things, the applicant asked the court to restrain Levitikal, its directors, officers, agents, representatives, assigns and other persons acting through it from selling, transferring, mortgaging, charging, leasing, alienating or encumbering the property.

The applicant also asked the court to restrain the company from representing itself to third parties as the owner of the property capable of being sold, transferred or otherwise encumbered.

In its ruling, the court granted the interim injunction restraining the defendant from taking any step or carrying out any act calculated to interfere with, overreach, dissipate, assign, transfer, sell, alienate, encumber or otherwise prejudice the subject matter of the suit pending the hearing and determination of the Motion on Notice.

The court specifically restrained Levitikal from selling, assigning, transferring, mortgaging, charging, leasing, alienating, encumbering, granting possession of, or otherwise creating any interest in the Victoria Island property, except as ordered by the court.

The court further granted an order authorising the applicant to publish the orders in national newspapers and online media circulating in Nigeria.

The publication is intended to notify members of the public, prospective purchasers, lenders, investors and other interested parties of the pending litigation and the applicant’s claimed interest in the property.

The court also directed the Nigeria Police Force, the Inspector-General of Police, the Assistant Inspector-General of Police, Zone 2, the Commissioner of Police, Lagos State, the Economic and Financial Crimes Commission and other relevant law enforcement agencies, where necessary, to provide security and assistance for the implementation and enforcement of the court’s orders.

The case arose from a dispute between the parties concerning the property and a Joint Venture arrangement for its development.

Court documents referenced by the applicant indicate that a Notice of Dispute and Request for Mediation and/or Arbitration dated September 7, 2026, had been issued in relation to the dispute.

The applicant’s case is that the dispute has resulted in court proceedings and arbitration concerning the property.

Levitikal Realties & Construction Limited has been identified in the proceedings as the defendant/respondent, while Dr. (Mrs.) Maryam Sani Abacha is the plaintiff/applicant.

The property has also previously been associated with an investigation by the EFCC, according to the materials presented by the applicant. However, the Federal High Court’s September 29 order in the present suit is a separate judicial development concerning the parties’ dispute over the property.

The court’s interim orders place restrictions on dealings involving the property pending further proceedings.

The matter was adjourned until November 9, 2026, for further proceedings.
